Saul Antonio Mendez may have earned his fifth DUI in his sleep.

 

Police found the 36-year-old repeat offender in a running vehicle Monday morning, open beer cans beside him, the car in drive and his foot resting on the brake, according to an arrest affidavit.

 

But the court document said that when an officer looked in the car to check the condition of the driver, Mendez was asleep.
